Let’s Try Again on…Gay Marriage

The California Supreme Court begins its deliberations on the constitutionality of the Proposition 8, which only elbowed its way onto the ballot after it had debated the constitutionality of gay marriage and found it was indeed constitutional.

Gavin Newsom, the mayor of San Francisco and a famously smart man was interviewed on NPR this morning to put the case in favor of overturning Prop 8. He said there were two choices. One was to grant Californian gay couples equal rights under the law to marry (which 18,000 couples have already done – before the ban went into effect) and the other was to deny those rights to gay couples.

He neglected to mention the third option which would protect everyone’s rights, whether they ‘support’ gay marriage or not. And that would be to change the “marriage certificate” into a “union certificate”, not just for Gay couples but for everyone.  A simple matter of changing a single word and then everyone would be equal under the law. If a couple, gay or straight, wants to get married after that, religiously or otherwise, well then no problem. They can have a buddhist marriage or a Protestant marriage or a Jewish marriage or a pagan marriage or even a religion free marriage. They can even call their liaison what they like, a pairing, a bonding, a mistake, heck it can even be a lifelong mind-meld if they like.

But the piece of paper that they have to sign in order to make the whole deal legal will cease to be a “marriage certificate”. Instead it will be called a “union certificate” or some such emotion-free term.
